As per the Office of the Executive Secretary, the express repeal of Executive Order 340 (series of 2004), through the issuance of Executive Order No 42 defining the powers and functions of the Subic Bay Metropolitan Authority (SBMA) Administrator and Directors, and the subsequent appointment of Atty Wilma Eisma as Chairman and Administrator of SBMA are the operative acts that effectively dissolved the basis for Mr Diño’s claim to his office.

No further directive to leave or notice of termination needs to be issued by the appointing authority.

This can be done by the new administrator herself.
