USEC. IGNACIO: Sa ngalan po ni Secretary Martin Andanar, ako po ang inyong lingkod, Usec. Rocky Ignacio at ito ang Public Briefing #LagingHandaPH.

Maya-maya lamang po ay makakasama natin sa programa sina Department of Justice Secretary Menardo Guevarra at Senator Pia Cayetano.

IGNACIO: Sa ating unang balita: Information at education campaign para sa Child Safety in Motor Vehicles Act dapat munang isagawa ng pamahalaan bago ang tuluyang pagpapatupad nito, iyan po ang suggestion ni Senator Bong Go kasunod ng kalituhan at hinaing ng ating mga kababayan sa implementing rules and regulations ng nasabing batas. USEC. IGNACIO: Nito lamang Martes ay nagsimula na po ang oral argument kaugnay po sa Anti-Terror Law. Naging mainit nga po ang unang sultada ng debate para kuwestiyunin ang nilalaman ng kontrobersiyal na batas. Ano naman kaya ang masasabi ng konsehong bumuo ng implementing rules and regulations nito? Makakasama natin ngayong umaga ang Kalihim po ng Department of Justice para ipaliwanag sa publiko ang batas at para sagutin na rin po ang iba pang imbestigasyon na pinangungunahan ng kaniyang ahensiya. Magandang araw po, DOJ Secretary Menardo Guevarra.

DOJ SEC. GUEVARRA: Good morning, Usec. Rocky. And good morning, Aljo. How are you?

USEC. IGNACIO: Opo, mabuti naman po. Secretary, as DOJ Secretary, so far ano po iyong assessment ninyo sa naging oral argument on the Anti-Terror Law nito pong Martes?

DOJ SEC. GUEVARRA: Actually, Rocky, I was in a meeting when the oral arguments were being held. But based on what I have read and heard about the initial day of oral arguments, I understand that much of the discussion focused on certain preliminary or procedural matters such as, for example, the matter of judicial hierarchy appropriate for the petitioners to file their petition immediately or directly with the Supreme Court rather than filing their petitions with courts with concurrent jurisdictions like the Court of Appeals and the Regional Trial Court.

I understand, in particular, that Justice Leonen questioned the …raised the issue of whether the matter is ripe for adjudication, kung mayroong actual na damage or injury that has already happened as would justify the filing of the petition, or is this something that can be resolved by the court on its face, facial challenge ‘no.

So these are interesting preliminary issues, and we have seen na doon pa lang sa preliminary issues na iyon ay mayroon ng mga fireworks. So we can expect a lot more [garbled] arguments when we come to the more important, substantive issues like the powers of the Anti-Terrorism Council, the issue of the alleged ambiguity or vagueness of the definition of terrorism and so forth [garbled] the matter of proscription and the powers of the AMLC and so forth and so on. So these are the substantive issues that are awaiting resolution by the court.

But first and foremost, the petitioners have to overcome the procedural issues that are raised buy the Justices of Supreme Court.

USEC. IGNACIO: Opo. Pero, Secretary, ang sinasabi po dito, malabo daw po iyong definition ng sinasabing Anti-Terrorism Act of 2020, iyan po iyong kinuwestiyon ng mga petitioners. Kasi sinasabi po nila, hindi raw po malinaw iyong tinatawag, nabanggit ninyo nga po kanina, “acts of terrorism” base po doon sa batas.

DOJ SEC. GUEVARRA: Well, that will be dealing with the merits of the case already ‘no kaya as much as possible, I would not like to comment. But I just want to say that iyong sinasabing vagueness or ambiguity in the law itself is somewhat… kumbaga, parang nabigyan ng lunas o remedy by the implementing rules and regulations that was crafted by an inter-agency group led by the DOJ.

So we’re hoping that with the implementing rules and regulations [garbled] the vagueness in the provisions of the law have been somehow remedied. So we’ll leave it to the Supreme Court to resolve whether the alleged vagueness has actually being remedied by the implementing rules and regulations. So let’s wait until that particular issue is dwelt upon by the protagonists in these petitions.

USEC. IGNACIO: Opo. Kasi, Secretary, ilang beses na nga pong nabanggit sa oral arguments iyong nabanggit ninyo kanina, facial challenge ng Anti-Terror Law. Wala naman daw po kasing actual na kaso na nadehado sa batas. Maaari ninyo po bang ipaliwanag sa ating mga kababayan, ano po ba itong facial challenge na ito?

DOJ SEC. GUEVARRA: My understanding about the term “facial challenge” ay iyong on the face ‘no, kaya siya tinawag na facial. On the face of the law itself ay makikita kaagad ang kaniyang invalidity or unconstitutionality, maybe not the entire law but certain provisions of the law are alleged to be on their face invalid for being unconstitutional.

So normally kasi, Rocky, ang situation is you don’t normally go to court unless there is an actual controversy na kailangan mong iharap sa husgado. Halimbawa, may actual damage has already been inflicted upon the complainant or upon the petitioner. Otherwise, kung wala pang actual na injury or damage, wala pang cause of action na tinatawag na kaya normally hindi pa sinasampa iyan sa court ‘no.

There is only one situation where wala pang breach or wala pang violation pero pupuwede nang i-file sa court, at iyon ang tinatawag na petition for declaratory relief but hindi ito iyong petitions before the Supreme Court.

Ang petitions before the Supreme Court are original petitions for certiorari and prohibition which involve grave abuse of discretion amounting to lack or excess of jurisdiction.

So iyong facial challenge, iyon ang allegations ng petitioners na on the very face of the law itself makikita naman na may invalid or unconstitutional na provisions. So let’s see how the Supreme Court will look at that contention ‘no.

USEC. IGNACIO: Opo. Secretary, sakto naman po doon sa oral argument iyong paglutang po ng kaso ng dalawang Aetas na inaresto matapos lumabag diumano sa Anti-Terrorism Act. Anila, sila po ay pilit na pinaaamin na miyembro ng mga NPA sa pamamagitan po ng umano’y pag-torture noong sila ay naka-detain. Paano po makakaapekto ito sa pagdinig at sa pag-aaral po ng Kataas-taasang Hukuman tungkol po sa naturang batas?

DOJ SEC. GUEVARRA: Well, parang ang intindi ko diyan ay mayroong motion for intervention ‘no. Kasi if I’m not mistaken, these two Aetas or natives ay hindi pa actual parties to the cases. That’s why they’re intervening and they’re saying that, in fact, because of this law ay nagkaroon na nga sila ng injuries suffered kaya parang ito iyong contention in support of the position na ‘ayan, mayroon nang injury, mayroon nang damage and therefore the Supreme Court may actually, kumbaga, consider the petitions now.

Hindi na magiging issue iyong facial challenge because right now ay mayroong mga individuals saying that they were actually injured or damaged by the law. But that is a contention and the court will do resolve kung papayagan ang kanilang intervention. If their intervention is not allowed, then we go back to the issue of whether the facial challenge will be sufficient.

USEC. IGNACIO: Opo. Secretary, may pahabol lang pong tanong si Leila Salaverria ng Inquirer ano po. Ang tanong niya po sa inyo: What does you think of Lt. Gen. Parlade’s threat to sue a reporter for violating the Anti-Terror Law over an article she wrote? Is this justified? Parlade indicated that the reporter could be considered aiding terrorists.

DOJ SEC. GUEVARRA: Usec. Rocky, you know, there is an intention expressed to file a complaint ‘no. So, maybe as a matter of propriety and prudence, my position as Secretary of Justice prevents me from commenting. Kasi you know, lahat ng mga ganiyang klaseng kaso na maaaring makarating sa Department of Justice, iyan ay iimbestigahan ng mga prosecutors. Walang involvement sa determination ng probable cause ang Secretary of Justice.

Ang mangyayari diyan, kapag ang aggrieved party ay hindi happy doon sa naging resolution ng prosecutor, that’s a time that an appeal may be had to the Secretary of Justice. Kaya ang SOJ ang may last say on whether or not a case should be filed in court ‘no, remedial case.

Kaya as much as possible, kapag mayroong mga ganiyang controversies, may possible filing of a complaint or a counter complaint, as much as possible I refuses to comment because I may preempt or I may prejudge something that may be brought before me pagdating sa dulo. Kaya I hope you understand my situation.

USEC. IGNACIO: Opo. Secretary, kaugnay naman po ng NPA at terorismo. Kayo po daw sa DOJ, ano daw po ang posisyon ninyo sa UP-DND accord? Panahon na nga ba daw po para bawiin itong kasunduan dahil nagiging recruitment ground umano ito, ang nasabing Universidad po ng NPA?

DOJ SEC. GUEVARRA: Usec. Rocky, again ha, medyo unique kasi iyong aking position as Secretary of Justice. Alam ninyo ang contending parties dito ha, iyong parang parties in dispute regarding the validity of the termination of the agreement between UP and the DND or AFP. Parehong government instrumentalities iyan eh – UP is a state university and of course the other party is the DND which is an agency under the Executive Department.

So kapag may ganiyang controversy, under the administrative code, they have to settle it either between themselves or bring it before the Department of Justice for administrative settlement or adjudication. So again, because of my situation na I may have to be called upon to resolve this issue if this matter is brought before the DOJ for administrative adjudication, I will have to decline making any preliminary comment at this time. I hope you understand my situation.

USEC. IGNACIO: Yes, Secretary, opo. Secretary, bigyan-daan po natin iyong ibang tanong ng ating kasama sa media ano po. Mula po kay Evelyn Quiroz ng Pilipino Mirror: You recently directed the National Bureau of Investigation to conduct an investigation into the reported manipulation of prices of pork and other basic commodities by certain unscrupulous groups and individuals. Are there indications daw po that there is a cartel manipulating the prices of prime commodities?

DOJ SEC. GUEVARRA: This arose because of the request ng Department of Agriculture which the Secretary of Agriculture manifested during the last Cabinet meeting, requesting the creation of a Sub-Task Group within the National Task Force on COVID-19 on economic intelligence, dahil nga sa mga nangyayari na parang shortage or sudden spike in the price of basic food stuff including pork.

So because of that, I have directed the NBI to start preparing. I supposed that the President will approve the recommendation for the creation of that sub-task group because that’s a very important step to take at this time and the DOJ and the NBI will provide full support for the investigation of the situation. If there is a cartel or if there is a group manipulating the supply and pricing of basic food stuff, then the NBI will surely focus on the existence of such group or syndicate or cartel.

Because talagang kapag may ganiyang [garbled] ay there is a very strong possibility na talagang ma-manipulate ang supply and consequently the pricing of basic food stuff. So we’ll get into that investigation very soon.

USEC. IGNACIO: Opo. Mula naman po kay Jam Punzalan ng ABS-CBN: What is the status po of the drug war review panel? When will the initial report submitted to President Duterte be publicized? When do you expect to finish po the entire review? Will the CHR and other stakeholders be involved?

DOJ SEC. GUEVARRA: Yes. Last December we submitted our initial report to the President on our findings, the review panel ‘no. Ang subject matter of the review panel, Rocky, as you probably know, ay iyong mga namatay sa illegal drug operations ng law enforcers natin [garbled] so [garbled] na iyan as of last year tumatakbo iyan sa mahigit 5,000 ‘no.

But the DOJ-led group selected certain pilot areas muna for the initial investigation at pinili namin iyong mga areas na concentrated or heavy ang number of incidents na pertaining to, iyong parang mga namatay because of drug operations. So iyang report na iyan is with the President and we made certain recommendations in the report [garbled] is to or [garbled] provide a copy of this report for their appropriate action ‘no.

So, nandoon tayo sa stage na iyon ngayon. We provided a copy of the report where we made certain findings, not so flattering against certain police enforcement officers ‘no involved sa drug operations and we gave the PNP sufficient time to comment on these findings. But be assured that this report, at least the findings and the highlights of this report, will be made public at the proper time.

Right now, we’re taking action on the findings that we have come up in this initial report. So hindi pa naman siya kumpleto talaga, mayroon pang mga further investigations na gagawin in other areas like in the Visayas and Mindanao. We do not want to make it appear na iyong findings namin in certain pilot areas like Region III, Region IV and certain major cities ay truly representative of what is happening throughout the country.

So the answer to my question is, at the proper time we will share our findings with the public, with the media but we will also include iyong mga actions that we intend to take arising from these findings. So hinihintay lang namin iyong tamang time para i-share but there is no intent to hide. You know the issue of transparency is very important to us, kaya rest assured that these findings will be made public at the proper time.

USEC. IGNACIO: Opo. Secretary, dito naman po sa usapin ng PhilHealth. May dalawampu daw pong bagong kaso kayong iniimbestigahan sa PhilHealth. So, ano na po iyong kinalaman ng mga kasong ito sa korapsiyon sa loob ng ahensiya, may top officials po ba na sangkot?

DOJ SEC. GUEVARRA: Rocky, iyong sa PhilHealth cases ano, iyan kasi ay tinapos na namin iyong report at na-submit na namin iyan sa Presidente. Pero if you will remember, the President also directed the DOJ to create another task force to deal with the corruption in the entire government. Kaya iyong… hindi namin natapos na investigation sa PhilHealth anomalies ay na-subsume na, na-cover na, in-absorb nitong panibagong task force on anti-corruption.

So, let’s focus on the PhilHealth cases muna ‘no. So far ang National Bureau of Investigation which is a major component of the task force has filed in the Office of the Ombudsman and with the Department of Justice at least 8 cases ‘no. Two of them involved iyong IRM o iyong Interim Reimbursement Mechanism ‘no. In the NCR, the amount involved was P2.7 billion and also another case involving the IRM, which affects a private company Braun Avitum and the amount involved is P33 million. Now, also filed with the Office of the Ombudsman ay certain fraudulent claims in Cebu involving a private hospital, Perpetual Succor Hospital. So iyon iyong mga na-file sa OMB.

At iyong na-file naman sa Department of Justice proper ay certain complaints pertaining to anomalies sa PhilHealth and these were filed at the Prosecutors’ Offices in Manila, in Tagum, in Koronadal, in Zamboanga and Tuguegarao. Kasama diyan iyong WellMed accreditation case.

So, mayroon kaming isang pinayl recently, ang Task Force Against Corruption through the PACC iyong Presidential Anti-Corruption Commission at ito ay in connection with some anomalies doon sa PhilHealth in Region 1, where a certain [garbled] was created by the name of Pamela Del Rosario. At itong fictitious person na ito ay nagpa-file ng claims sa PhilHealth, when in fact ay wala namang such person existing. Na-file na rin iyan sa OMB or Office of the Ombudsman.

Ngayon doon sa PhilHealth, ongoing pa rin iyong investigations, mayroon pas kaming hindi natapos diyan and we are focusing on the legal sector and on the ICT or in the information technology sector ng PhilHealth.

So, with former NBI Director Dante Gierran at the helm of PhilHealth, we hope that we will be able to gather evidence more easily considering that the new president came from the NBI before.

USEC. IGNACIO: Secretary, update din daw po doon sa Anti-Corruption Mega Task Force na pinangungunahan din po ng DOJ kaugnay naman po doon sa DPWH?

DOJ SEC. GUEVARRA: Thank you for asking, Usec. Rocky. So far, as of yesterday, itong Task Force Against Corruption ay mayroon ng na-receive na 185 complaints from the public and from other agencies.

And ginagawa kasi ng task force diyan, sino-sort out namin kung alin iyong mga complaints alleging corruption, malversation and stuff like that at alin iyong hindi properly covered under the jurisdiction ng task force. So, inalis namin iyong hindi talaga pang-corruption issue at we have retained as of yesterday 166 of corruption cases. Sa total na iyan napansin namin na mayroong mga nagdu-duplicate; parang complaints about the same matter, coming from two or more different persons.

So anyway, diyan sa total number na iyan na-refer sa task force, 58 had so far being evaluated. At diyan sa na-evaluate na namin na iyan, we have taken action on at least 36; taken action means, we have referred this to certain agencies for further investigation or to the NBI for case build up or to special unit within the DOJ para [garbled] because some of these allegations are quite general, systemic and kailangan ng mas masusing pag-aaral bago mag-file ng anything with the Ombudsman or with the DOJ. Kailangan maliwanag muna kung ano iyong complaint na tinutukoy, kasi ayaw naman naming magmi-mention ng mga cases against [garbled] na hindi pa sufficient ang [garbled] kasi baka makasira sa kanila kung it will turn out na wala namang factual basis. So nagiging maingat din kami sa paghawak ng mga ganitong klaseng complaint Usec. Rocky.

USEC. IGNACIO: Secretary, regarding naman po sa Dacera case. Nakakadalawang autopsy report na po ang PNP at parehong aneurysm po ang resulta nito. Sa NBI, kumusta naman po ang progreso ng imbestigasyon sa nasabing kaso?

DOJ SEC. GUEVARRA: Ang National Bureau of Investigation kasi ay inatasan ko rin na gumawa ng [garbled] and according to the Spokesperson ng NBI si Deputy Director Ferdinand Lavin ay they are winding up iyong kanilang investigation.

As far as I know ay natapos na ang kanilang forensic examination, mayroon na silang toxicology report. But you know, the NBI is trying to be as thorough as possible, all bases they are trying to cover, so mayroon pa silang hinahanap na certain other witnesses na hindi na nakapag-testify. [garbled] I think [garbled] at mayroon silang hinahanap pang mobile phones na isa-subject to a forensic examination.

So I think pagtapos na rin sila and I am sure that bago matapos ang preliminary investigation being conducted by the DOJ ay masa-submit na ng NBI iyong kanilang final report [garbled].

USEC. IGNACIO: Pero Secretary, paano po kung iba iyong lumabas sa parallel investigation ng NBI sa nasabing case. Hindi po ba magkakaroon ng confusion ang publiko sa ating awtoridad?

DOJ SEC. GUEVARRA: Well, that is a possibility assuming na magkakaroon nga ng different results ‘no, ang forensic ng PNP at ang forensic examination ng NBI. So kapag ganoon, I guess ang gagawin ng Investigating Prosecutor Office sa Makati ay ipatawag at magpatawag ng clarificatory hearing, baka ipatawag ng Prosecutor na nag-i-investigate ang representatives ng PNP [garbled].

USEC. IGNACIO: Medyo nagkakaroon po tayo ng problema sa linya ng komunikasyon. Aljo, babalikan natin si Secretary maya-maya lamang.

BENDIJO: Sa iba pang mga balita: Patuloy po ang pag-iikot ng tanggapan ni Senator Bong Go sa iba’t ibang probinsya ng bansa. Noong nakaraang linggo ay nagtungo ang kanyang team sa Koronadal City sa South Cotabato kung saan namahagi sila ng ayuda sa mga kababayan nating magsasaka at indigenous people. Binisita rin ng senador ang mga residente ng Barobo sa Surigao Del Sur na naapektuhan po ng mga nagdaang bagyo noong nakaraang taon. Naroon din ang DSWD, Department of Agriculture, DOLE at iba pang mga ibang ahensiya upang mag-abot ng tulong. Panoorin natin ito:

USEC. IGNACIO: Samantala, balikan po natin si Secretary Guevarra. Secretary?

SEC. GUEVARRA: Hello again, Rocky and Aljo! Pasensiya na at ang aming signal dito ay kung minsan nawawala – sa Padre Faura.

USEC. IGNACIO: Opo, paumanhin din po. Secretary, puwede ninyo po bang ituloy iyong paliwanag ninyo tungkol kanina sa Dacera case, iyong tanong po natin na in case po na magkaiba iyong resulta ng parallel investigation?

SEC. GUEVARRA: Well, of course, we’re hoping na hindi na magkakaroon ng divergence. Pero kung sakali man na mangyari iyon because hindi ko pa naman talaga nakikita, Usec. Rocky, iyong report ng NBI.

Siyempre, magkakaroon ng confusion kapag nangyari iyan kaya ang nakikita kong mangyayari diyan sa situation like that, iyong investigating prosecutors sa Makati, iyong nagko-conduct ng preliminary investigation will probably call a clarificatory hearing as part of the preliminary investigation at maaaring tanungin niya ang representatives ng PNP at NBI kung ano ang kanilang scientific basis for their findings.

And I suppose na madi-determine naman ng investigating prosecutors kung alin ang bibigyan niya ng mas higit na timbang sa pag-i-evaluate kung may probable cause ba dito sa kaso na nai-file ng pamilya ni Cristine Dacera.

Anyway, if you will remember ang issue naman dito ay kung ang charge or ang complaint ay kung mayroong rape with homicide, ‘no. So, essentially iyan ang dapat na ma-resolve ng investigating prosecutor. Mayroon bang mga ebidensiya na magpapakita na ni-rape at naging sanhi ng pagkamatay nitong si Cristine Dacera. Iyan ang basic issue diyan.

USEC. IGNACIO: Opo. Secretary, tungkol naman po doon sa tumataas na umano ay bilang ng lawyer killings, paano naman po natin sinisiguro iyong kaligtasan ng ating mga abogado sa bansa?

SEC. GUEVARRA: Alam mo, Usec. Rocky, talagang ang profession ng mga abogado whether nasa private practice o nasa government like sa prosecution service or nasa judiciary ay talagang mapanganib, ‘no kasi nasa very nature ng work ng mga lawyers iyan eh. Part of, kumbaga, parang part of the profession na nai-expose ka sa ganiyang klaseng danger.

But it doesn’t mean na we will take it for granted. Kaya nga nagkaroon kami recently ng mga series of dialogues kasama pati ang Supreme Court at ang representatives ng Integrated Bar of the Philippines to discuss how to deal with this situation.

Kasi ang mga lawyers, ang mga prosecutors, ang mga judges, isama na natin pati iyong sa law enforcement who are also lawyers, sila iyong nagpapatakbo ng ating criminal justice system. Not necessarily criminal, kahit iyong sa mga civil cases, administrative cases. So, hindi tatakbo iyang sistema na iyan kung walang mga abogado.

Kaya nakakabahala kung mayroong patuloy na nababalita na napapatay because of their involvement sa kanilang profession. So on the part of the DOJ, Usec. Rocky, ang ginagawa namin sa ngayon ay iniimbentaryo namin ang lahat ng mga kaso na may napatay na lawyers or prosecutors or judges. And after we have completed and inventory of all these cases ay imu-monitor namin very closely ang development sa investigation at sa prosecution.

Kung halimbawa, sa investigation ay nagkakaroon kami ng problema sa pag-gather ng evidence ay wala kaming ibang pupuwedeng gawin kung hindi i-intensify further ang efforts ‘no para makakuha ng ebidensiya at magkaroon ng resolution ang mga imbestigasyon na ginagawa.

At iyon namang mga nasa korte na at prino-prosecute na, ang kailangan lang gawin diyan ay talagang bantayang mabuti at madala itong mga cases na ito to their conclusion para naman mabigyan ng hustisya iyong mga kapuwa abogado namin na napatay, maaaring may connection sa kanilang trabaho which is the most likely case or maybe for some other reasons – it could be personal; it could be business; it could be family. Maraming reasons na maaaring naging sanhi ng pagkamatay ng mga abogado. But by and large, we believe na mas may kinalaman iyan sa kanilang profession as lawyers.

So we’re doing something about it. We cannot afford to disregard this situation kasi ang ating buong justice system ay mapeperhuwisyo, ay mada-damage kung ang ating mga abogado will be killed just like that.

Patuloy po nating nararamdaman ang epekto ng pandemya kaya malaking tulong sa ekonomiya kung maisasabatas na po ang CREATE Bill na kamakailan lamang po ay lumusot sa bicameral conference committee ng Senado at Kamara de Representantes.

Para po makibalita sa usaping iyan, makakasama po natin si Senator Pia Cayetano. Good morning po, Madam Senator.

SEN. PIA CAYETANO: Good morning.

USEC. IGNACIO: Opo. Senator Pia, para po—kasama ko po si Aljo Bendijo dito, ano po. Para po sa kaalaman muna ng ating manunood, ano po iyong CREATE Bill na inyong inisponsoran [sponsor] sa Senado? At paano po nito matutulungan ang mga negosyo na makabawi po mula sa pagkadapa sa epekto ng pandemya?

SEN. PIA CAYETANO: Alam mo, napakahalaga nitong batas na ito kasi ‘di ba sa mga nakaraang buwan, halos isang taon na, talagang parang nalulunod tayo sa problema na dala ng COVID ‘di ba. Kumbaga, kung ano iyong normal na problema natin, nadagdagan pa dahil sa COVID dahil hirap ang tao maghanap ng trabaho; iyong negosyo, they’re struggling.

So ang kagandahan nitong CREATE na ito—na-conceptualize ito, believe or not, 25 years ago pa, na pagandahin iyong incentives para iyong mga investors ay magustuhan nilang mag-invest dito sa Pilipinas. So iyon 25 years in the making na iyan.

Ang nangyayari kasi, kaniya-kaniyang incentives ang inu-offer, hindi ho coordinated. So the first part of CREATE is iyong nagbibigay ng maganda and very competitive incentives compared sa mga ibang neighboring ASEAN countries natin.

So gusto sana natin, iyong ating kagalingan sa English language – we are very competent in English, this is a global world – people will love to invest in our country. So when we passed CREATE na magaganda ang incentives, parang sinabi natin sa mga investors, “Pasok kayo dito. Maganda ang incentives. Bawas ang tax na babayaran ninyo sa mga unang taon because eh kayo naman ang magbibigay ng trabaho; magbibigay naman kayo ng technology.” So that’s the first part of CREATE, iyong incentives.

The second part really affects every business person. Kung kayo ay may korporasyon – and it doesn’t matter ha kung small or big dahil pati naman ho mga maliliit na negosyante ay puwede naman hong magbuo ng korporasyon – ang tax natin ngayon na nasa 30% ay bababa agad ng 25%. So kung ang isang korporasyon ay kumita ng one million, dati 30% noon ay babayaran as tax, that is 300,000; ngayon, less 5% so that would be 250,000 – malaking kabawasan.

And in addition to that, kung small and medium ka na hindi lumalagpas ng five million iyong kikitain mo – malaki na iyong five million ha – 20% lang ang iyong tax na babayaran.

So in other words, imbes na kukunin ng gobyerno iyon tax, iyong pera, binabalik niya sa tao, gamitin ninyo sa kung paanong paraan na gusto ninyo. Gusto ninyong magdagdag ng manggagawa, you want to hire more employees, go ahead. Gusto ninyong dagdagan ang benepisyo ng employees ninyo, go ahead. Gusto ninyong bumili ng makinarya, go ahead. Kung anuman—nilalagay itong pera sa kamay ng mga negosyante.

So iyon iyong dalawang main features. Marami pang iba, we included mga VAT and duty-free importation of the COVID vaccine. Pati ho iyong tax doon sa mga educational and health institutes natin, nabawasan ho nang todo kasi gusto natin na … maraming nagsasara ngayon so gusto nating makatulong. So isa iyan sa konti pero mauubos ang oras natin kung iisa-isahin ko. So iyon na iyong pinaka-major, iyong mga binanggit ko.

USEC. IGNACIO: Opo. Pero, Senator, ano po ba itong iba pang tax break sa ilalim daw po ng CREATE Bill?

SEN. PIA CAYETANO: Well, katulad nga noong inumpisahan ko nang banggitin ‘no, siguro uulitin ko na ang pinakamahalaga doon sa pagbawas ng income tax, corporate income tax both for small, medium and large corporation, iyon ngang mga additional na binibigay natin na tax incentives para doon sa pagpasok ng gamot, hindi lang iyong COVID vaccines pero ho pati iyong para dito sa kinikilalang top na nakakamatay sa atin ano, kasama po diyan ang TB, kasama po diyan ang cancer drugs at iba pa.

And then, nabanggit ko nga, pati ho sa educational sector mayroon din tayo; binawasan din natin ang tax nila. And kung mayroon tayong mga negosyanteng nakikinig ‘no, kasi medyo teknikal na itong sasabihin ko, pero mayroon hong tinatawag na MCIT [Minimum Corporate Income Tax], ginawa ho nating one percent iyan; dati two percent. And iyong three percent percentage tax, ginawa nating one percent, babalik na lang ito sa three percent after three years. So ito po ay good for two years, basically – from ngayon hanggang June 2023. So really ano ito, support for the business sector kasi kung buhay ang negosyo natin, may trabaho ang tao, makakauwi sila ng pera at buhay din ang pamilya nila.

ALJO BENIDJO: Magandang tanghali, Senator Pia. Ako po si Aljo Bendijo, ma’am. Linawin lang po natin: Sa ilalim po nitong CREATE Bill, matatanggal po ba ang insentibo sa buwis ng mga negosyo o mas marami pang benepisyo ang mapapakinabangan ng mga gusto pong mamuhunan sa ating bansa?

SEN. PIA CAYETANO: Yes, thank you for that question, Aljo. Maganda iyan, kasi alam mo noong unang dinidebate itong CREATE, ang pangalan pa niya noon is CITIRA, umaangal ang mga negosyante kasi akala nila iyong mga … ito ho iyong mga nakakatanggap ng incentives doon sa mga economic zones ‘no katulad ho ng Subic, Bataan—saan pa? Sa Cebu, may mga economic zones po tayo diyan ano. Akala nila, basta-basta naman ho tatanggalin sa kanila iyon; hindi ho totoo iyon. In fact, ang nangyari dito, kung kayo ay isang registered business enterprise na tumatanggap ng incentives, tuluy-tuloy po iyan for ten years, okay? Tuluy-tuloy iyang pagtatanggap ninyo. Kung income tax holiday which means wala kayong binabayaran na income tax, iu-honor iyon, tuluy-tuloy iyon. Tapos iyong kung may natatanggap kayong special income earning, iyon rate – tawag po noon is GIE – tuluy-tuloy pa rin iyan for 10 years so walang tatanggalin nang basta-basta.

And then iyong mga bagong applicant o kaya iyong mga ngayon na magri-reapply ulit, napakahaba ho at napakaganda ng incentives binibigay natin sa kanila. It’s equivalent to 14 to 17 years. So kumbaga kayo ang GM or Presidente, baka retired na kayo eh iyan pa rin ho ang tinatanggap na incentives ng korporasyon ninyo. So siguro ho wala nang makakapagsabi na hindi maganda ang naibigay natin and ang purpose natin dito is tanggap natin na mahirap ang panahon, gusto natin kapag tiningnan iyan ng mga investors na may pera, “Uy, maganda diyan sa Pilipinas ha. Pasok tayo diyan…” at lalong magkakaroon ng trabaho.

So maganda ho itong mga incentives, there is nothing to worry about. In fact, ang daming business associations na tuwang-tuwa ho na finally napasa na ito kasi ho noong November pa ito napasa ng Senado eh. Kaya antay na antay sila na ma-finalize na ito, maging batas na talaga ito.

BENDIJO: Opo. Balikan ko lang po iyong bakuna po natin, Senadora. So magkakaroon po tayo ng duty free vaccines at VAT free na rin sa—

SEN. PIA CAYETANO: Ah, yes.

BENDIJO: Opo, sa droga para sa COVID-19.

SEN. PIA CAYETANO: We clarified that also that it’s VAT and duty-free exempt.

BENDIJO: All right. So personal, iyong mga PPEs and baka may droga na rin para sa COVID-19 at ng mga trials sa mismong FDA?

SEN. PIA CAYETANO: Yes, mga basta related sa COVID.

BENDIJO: Opo. How about po sa countryside development? Papaano po makakatulong itong CREATE Bill?

SEN. PIA CAYETANO: Yes. Maganda kasi itong pagkagawa namin ng CREATE dahil in-identify po natin ang mga lugar. Kumbaga, we categorized every area in the country such that Metro Manila, siya na ang pinakamababang incentive na matatanggap kasi buhay na ang negosyo sa Metro Manila ‘di ba? I mean, siyempre kailangan pa rin ng tulong and that’s why nandoon iyong binabaan ang corporate income tax para lahat ng negosyante kahit saan ka sa buong Pilipinas, makikinabang ka.

But in terms of incentives, iyong mas malayong mga lugar, iyon ang pinakamagandang incentives. Kaya panawagan ko talaga sa mga local government officials natin and even the local businessmen, now is a good time to look for partners na madadala ninyo, kung may mga economic zones doon sa lugar ninyo or kahit walang economic zone doon because we have incentive packages na mas maganda kung doon sila magdi-develop.

Outside Metro Manila, maganda ang package nila and then even outside, iyong ibang mga metropolitan, iyong Metropolitan Cebu, Metro Davao. Kung mas malayo pa, mas maganda din ang tatanggapin nilang incentive kasi ang gusto natin mag-invest sila doon sa mga, iyon nga, iyong mga rural areas natin, iyong mga areas natin na kulang pa talaga sa mga technology and support system, doon natin sila gustong magbuhos ng investment.

BENDIJO: Opo. Sa panukalang batas naman na katulad po nitong Safe Pathways Network Act, Senator, na pumasa na sa third and final reading. Ano po ba ang ibig sabihin ng safe pathways network, ma’am?

SEN. PIA CAYETANO: Ah, yes. Batas ko din iyon ano kaya it’s been a good week for me kasi this week pumasa itong Safe Pathways Network on third reading but just to clarify, pasado sa Senate, hindi pa siya pasado sa House. So I’m sure gagalaw na iyan sa House, nakausap ko na rin iyong leadership naman sa House na sana ipasa na, trabahuhin nila ito.

Because if you recall, in the early days of COVID walang masakyan ang mga frontliners ‘di ba? And marami sa kanilang kumbaga, sabi nga organic ang pag-develop, organic ang paglaganap ng paggamit ng bisikleta. Kasi iyon na ‘yung naging pinakamadali and safest way to travel because restricted nga ang public transportation. Tamang-tama naman matagal na ho akong nag-a-advocate ng sustainable transportation which includes alternative modes of transportation including bicycles.

Kasi alam natin, if you do a survey, a lot of people only travel a very short distance na puwedeng 500 meters, one kilometer… So iyong picture na nakikita ninyo ngayon, that’s actually a bike donation. Itong walang mask, luma na hong picture iyan ha, hindi ako nagba-bike nang walang mask [laughs]. ‘Ayan si Mayor Lino iyan, nagba-bike din iyan na depende sa pupuntahan niya sa Taguig. Ito iyong bike lanes namin sa Taguig.

So anyway, talagang maraming nagta-travel nang napakaiksing distance and they don’t need to take public transpo. Medyo minsan mahirap naman din maglakad, mainit naman talaga sa Pilipinas, so biking is a faster and efficient way to travel. And the reason it’s called ‘safe pathways network’ is because itong dadaanan ng bisikleta, iyan iyong pathway and gusto natin network, kabit-kabit. Kasi dati may nabalitaan tayo, I’m sure narinig ninyo iyon, “Uy may pathway doon sa,” I think sa Antipolo iyon, may bike lane pero parang dead end, parang nagkaroon na ng kotse, humarang doon iyong kotse… ‘Ayan tingnan ninyo iyong sign – motor vehicles, do not enter. Bike lane kasi iyan…

So ito, gusto natin kabit-kabit ang mga bike lanes para iyong nakabisikleta, makakarating siya doon sa pupuntahan niya. So it’s now a requirement that LGUs come up with their own regulations, they will consult naman with DOTr, but in Metro Manila, kasama din sa consultation ang MMDA. And it’s important to note that hindi lang bicycles ito ‘no, ang Safe Pathways Network include slow streets.

Explain ko lang ang slow street. Ang slow street would be a street that the LGU, of course with the residents decide na pasasara nila – puwedeng certain hours of the day, puwedeng weekend, bahala sila – na kasi gusto nila na ang makagamit ng kalyeng iyon eh mga naglalakad, nakabisikleta, nanay na may stroller, matatanda na gustong maglakad-lakad. Kasi hindi naman ho dapat kotse lang ang nakakagamit ng kalye. Iyon ho ‘yung purpose noon especially in those areas na maiksi lang ang pupuntahan. We really need this network of safe pathways.

BENDIJO: So itong mga bike lanes dito, Senator Pia, hiwalay sa mga sasakyan?

SEN. PIA CAYETANO: Ah yes, yes. Thank you for pointing that out. Requirement talaga na hiwalay iyan kasi kapag pinagdikit mo – ako, nagba-bike talaga ako in other countries and in our country at hindi ho ako masyadong komportable mag-bike within Metro Manila na wala hong, unang-una, walang harang – talagang medyo magkakaroon ka ng comfort level talaga kung mayroong ano iyan, kung hiwalay talaga. So, kung makikita ninyo iyong picture noong sa Taguig, hiwalay talaga, may island na naghihiwalay.

Now of course it is possible na magku-converge iyan kasi nga network of pathways, may time na magku-converge iyan, let’s say sa main highway then maybe doon puwede talagang parang hindi naman iyong—hindi naman requirement na lahat ng dadaanan eh talagang nakahiwalay na bike lane ‘no. Mayroon talagang convergence iyan hindi maiiwasan especially iyong metropolitan areas.

Pero sisiguraduhin natin na the safety of the bikers is most important because at the end of the day, buhay din ng tao iyan. Marami na ho akong nakaaway na driver ho ng mga truck, truck pa nga normally eh kasi sinasabi ko na kahit anong gawin mo, kapag binundol mo ako, patay ako or malulumpo, so huwag ka nang makipagtalo.

BENDIJO: Dumadaan ako diyan, sa C-6 po sa Taguig. Napakaganda po ng bike lane diyan. Taga-diyan po ako eh…

SEN. PIA CAYETANO: Ah, yes. Next time dapat naka-bike ka ha.

BENDIJO: Opo. Senator, may prinupose din kayong bill tungkol naman sa pagkakaroon ng tinatawag na vaccine passport, marami pong nagtatanong nito. Anu-ano po sakop nitong bill at papaano ba ito makakatulong sa pag-rollout ng mga bakuna kontra COVID-19 sa bansa? Possible bang ito ay maaprubahan kaagad ngayong nalalapit na ang rollout ng bakuna at maraming mga LGUs na rin ang naghahanda?

SEN. PIA CAYETANO: Ay, thank you. Yes, I filed the Vaccine Passport Bill and idagdag ko na rin ano, isa pang bill na amending the Bayanihan to bill along with the Senate President, nag-file kami niyan. So dalawang very important bills ito that should be given priority nitong panahon ng COVID.

Kasi iyong vaccine passport, alam ninyo naman once na mabakunahan ka, we do not know the exact amount of protection, okay? Kapag ini-interview ako sabi ko that is an answer only the experts can give. Ako, I am just putting the system in place para naman magamit natin iyong benefits ng vaccine. So kung mabakunahan ka, ano ngayon? Ano ngayon? What does that mean?

So government can come up with regulations na kapag nabakunahan, baka mas maraming lugar na puwede kang pumunta dahil mas malaki ang chances na hindi ka makakapag-spread ng germs, baka mas madali lang makasakay ng eroplano at maka-travel sa ibang lugar natin na hindi ka na kailangan i-PCR. I don’t know exactly ha, hindi ko sina-suggest iyon. I’m giving examples na what would the possible benefits of being vaccinated. What would those benefits be and it should be contained in the vaccine passport so that napapakita ito. Para ngang passport, “Ah nabakunahan ako kaya puwede kong gawin ito.”

Pero ang gobyerno, ang IATF along with the experts will decide ano iyon. Ano iyong privileges kapag nabakunahan ka and at the same time it would also give parang ano na rin iyan… database na rin iyan ng ating gobyerno kasi makikita nila anong klase ang ibinakuna sa iyo. Paano kung it turns out na mas maganda pala ang effect ng isang bakuna, ‘di malalaman nila na itong grupo na ito, ito ang nabakunahan baka sa susunod puwedeng iba. Hindi ko alam… hindi ko alam.

Pero the point is my record and once may record ka eh information is power, marami kang magagawa hindi ba with that information.

ALJO BENDIJO: Dako naman tayo sa pinakahuling tala po ng COVID-19 cases sa buong bansa.

Base sa report ng Health Department kahapon, ika-4 ng Pebrero 2021, 531,699 na po ang total number of confirmed cases matapos maitala ang 1,590 new COVID-19 cases kahapon; 55 katao ang bagong mga nasawi, ito ay umabot na sa 10,997 cases ang kabuuang bilang ng mga namatay sa COVID-19 sa Pilipinas ngunit patuloy ang pagdami ng mga nakaka-recover. Umakyat na po sa 487,927 matapos makapagtala kahapon ng 249 new recoveries. Ang total active cases – 32,775 sa ngayon

USEC. IGNACIO: At iyan nga po ang aming balitang nakalap ngayong araw. Ang Public Briefing po ay hatid sa inyo ng iba’t-ibang sangay ng PCOO sa pakikipagtulungan ng Department of Health at kaisa ng Kapisanan ng mga Brodkaster ng Pilipinas (KBP).
