CABAL: Sir, iyong reaction dito sa US resolution calling for the release of Senator De Lima?
SEC. PANELO: Well, that’s the decision of the committee. Apparently they have been misled by the reports coming from the opposition, as well as media outlets who had been biased against the administration. What I can’t understand is they adhere not to understand the judicial process of this country.
You know, they should know, because the judicial system of that country and ours are almost the same, there is a preliminary investigation conducted by another administrative officer, meaning the public prosecutors who investigate the case and they find probable cause, then the respondent will be charged in court, but before the warrant of arrest shall be issued, there will be another determination of the existence of a probable cause by a judge after evaluating the evidence, in other words there are processes before a person can be charged and then bring him in court.
So, I cannot understand why this committee is oblivious of that processes that went through in relation to the former senator or for Senator De Lima.
CABAL: Sir, kasama rin po kasi doon sa resolution ng foreign relations committee iyong posibleng sanctions din, pinapa-sanction nila iyong mga sinasabing opisyal ng Pilipinas na nasa likod daw nitong pagpapakulong kay Senator De Lima, kasama diyan iyong travel ban or iyong freezing of assets nitong mga foreign officials sa America, nitong mga local officials sa Amerika. May reaksiyon po kayo diyan na may mga ganiyang sanctions pa na gusto para sa opisyal natin?
SEC. PANELO: Ganun na nga iyong sinabi ko kanina, iyon nga ang hind ko maintindihan sa kanila, bakit hindi nila maintindihan iyong dinadaanang proseso bago ang isang mamamayan sa Pilipinas ay idedemanda, itsa-charge sa hukuman at ikukulong. So walang kinalaman ang mga opisyales, ang nagde-determine ng pagkakulong ng isang tao ay ang hukuman at hindi ang mga opisyales ng anumang sangay ng ating pamahalaan.
CABAL: Sir, meron po ba kayong message kay US Senator Ed Markey na siyang nagsusulong nitong resolusyon na ito?
SEC. PANELO: Eh siguro dapat mag-aral sila, pag-aralan nila kung ano ang prosesong dinadaanan natin, para hindi sila nagkakamali at hindi sila dapat nakikinig sa mga sabi-sabi, iyong mga nababasa nila sa diyaryo, iyong mga natatanggap nilang mga liham kung saan-saan galing at nagsasabing si Senator De Lima ay pini-persecute – hindi totoo iyon.
CABAL: Sir, some senators are saying na garapal na pakikialam at panghihimasok daw ito ng Amerika sa mga affairs ng Pilipinas.
SEC. PANELO: Eh ganoon na nga, exactly!
